The agreement that governs your use of Assessly, your account, acceptable use, our AI features, liability, and the Indian law that applies.
These Terms of Service are an agreement between you and Assessly Technologies Private Limited ("Assessly", "we", "us"), a company incorporated in India under the Companies Act, 2013 (CIN U58201KA2026PTC222387), registered office CTS No. 2557/2B, Mahatma Phule Road, Shahapur, Belagavi 590003, Karnataka, India. They govern your access to and use of the Assessly platform.
By creating an account, taking an assessment, or otherwise using Assessly, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the platform.
If your institution has signed a separate agreement with us, an order form, master services agreement, or pilot agreement, that agreement governs your institution's use of Assessly, and these Terms fill in anything it doesn't cover. For individual users, these Terms apply in full.
Eligibility. You must be able to form a binding contract under the Indian Contract Act, 1872 to use Assessly on your own behalf. If you are under 18, you may use Assessly only through an institution that has obtained any parental consent the law requires, as described in our Privacy Policy.
Assessly is an evaluation and learning platform for universities and engineering teams. Depending on what your institution enables, it may include coding assessments and auto-grading, AI-graded written explanations, AI voice interviews, practice and learning tracks, the Ace teaching-and-learning copilot, the Pulse community, and analytics for instructors and administrators.
We improve the platform continuously and may add, change, or retire features. We won't make a change that materially reduces a paying institution's core functionality during its term without reasonable notice.
To use the platform you register for an account, directly or through your institution's invitation, and you agree to:
Accounts are personal to you. You may not share, sell, or transfer your account, or let anyone else use it.
Many people reach Assessly through an institution. Where that's the case:
For data-protection purposes, the institution is the Data Fiduciary for this data and we act as its Data Processor, as set out in our Privacy Policy.
Assessly is an integrity-first platform. You agree not to:
Zero-tolerance policy
Any attempt to bypass the proctoring suite, inject malicious code into the execution pipeline, or manipulate evaluation telemetry will result in immediate and permanent account termination, and the associated institution will be notified.
Assessly provides sandboxed execution environments (cloud compiler runtimes) for solving and testing code. Runtimes are subject to strict constraints:
Our communication spaces, Pulse channels and direct messages, are built for professional collaboration. You agree to follow our community rules:
You own the content you post, and you're responsible for it. As an intermediary under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Assessly hosts user content but does not author or endorse it. You must not host, post, or share content that is unlawful under those rules, including content that is defamatory, obscene, harms a child, infringes intellectual property, or is otherwise prohibited by Rule 3(1)(b).
Moderation & takedown: we may review chat telemetry, mute users, remove content, or revoke chat access for breaches of these guidelines or the law. To report unlawful content, write to our Grievance Officer at grievance@assessly.in.
Assessly awards XP, streaks, and league divisions to encourage consistent practice. Manipulating these mechanics is prohibited:
Assessly's AI features, automated grading, the Ace copilot, AI interviews, and explanation scoring are assistive. They are powerful but not infallible: AI output can be wrong or incomplete, and it is not professional, legal, or career advice. Final academic and evaluation decisions rest with your institution's faculty, not with a model.
AI features are included under our Fair Use Policy, which explains what "unlimited" means and where the soft limits sit. Using the AI features means you accept that policy.
The platform, its original content, features, and evaluation rubrics are owned by Assessly and protected by the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws. "Assessly" and our logo are our trademarks; you may not use them without our permission.
Your code and work. Your submissions remain yours. By submitting them, you grant us a limited licence to host, run, analyse, and test them strictly to evaluate your work and provide feedback to you and your institution.
Feedback & surveys. If you give us ratings, suggestions, emoji, or written comments, you grant Assessly a royalty-free, worldwide, perpetual, and irrevocable licence to use them to operate and improve our services, without credit or payment.
Assessly is sold to institutions, not priced publicly. Fees, terms, and renewals are set out in the order form or agreement between Assessly and your institution. Where fees apply:
Bug bounty rewards are governed by the bug bounty program terms, not by this section.
Assessly is provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties, express or implied, about the platform's reliability, accuracy, fitness for a particular purpose, or uninterrupted availability.
While our execution pipelines are highly reliable, we don't guarantee the platform will be free of errors or latency spikes during peak load. AI-generated output may contain mistakes and should be reviewed before it is relied on.
Third-party services. The platform relies on third-party infrastructure and AI providers, our subprocessors, and may link to third-party sites. We are not responsible for third-party services or their terms.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law, including liability for fraud or for death or personal injury caused by negligence.
You agree to indemnify and hold Assessly harmless from claims, losses, and reasonable expenses arising out of your misuse of the platform, your breach of these Terms or of any law, the content you post, or your infringement of someone else's rights. We will tell you about any such claim and may take over its defence.
You can stop using Assessly and delete your account at any time from your account settings.
We may suspend or terminate your access if you breach these Terms, if your institution's access ends, if required by law, or to protect the platform and its users. We'll give notice where it's reasonable to do so; serious breaches, such as integrity violations, may lead to immediate termination.
On termination, your right to use the platform ends. Provisions that by their nature should survive, such as intellectual property, disclaimers, limitation of liability, indemnity, and governing law, continue to apply. Data handling after termination follows our Privacy Policy and your institution's agreement.
Assessly encourages responsible security research. If you participate in our bug bounty program, you agree that:
Violation of disclosure: any unauthorised public disclosure is a material breach of these Terms, disqualifies you from any reward, and may result in legal action or account termination.
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to the paragraph below, the courts at Belagavi, Karnataka, India have exclusive jurisdiction over any dispute relating to Assessly or these Terms.
Resolving disputes. We'd much rather sort things out directly, please contact us first and we'll try to resolve any concern in good faith. Disputes that can't be resolved that way may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Belagavi and conducted in English. This does not stop either party from seeking urgent interim relief from a court.
For complaints about content, conduct, or these Terms, including content you believe is unlawful, contact our Grievance Officer under the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
We acknowledge complaints within 24 hours and aim to resolve them within 15 days.
